Biography
Garret Flynn is a commercial barrister practising in Dublin. Garret is regularly instructed in high-value, complex matters, particularly in relation to company, insolvency, general commercial and intellectual property disputes.
Prior to becoming a barrister, Garret qualified as a solicitor in London and later worked as a corporate solicitor with one of Ireland’s largest law firms.

Company / Insolvency
Instructed as sole counsel for the US Trustee in Bankruptcy of Kiawah Doonbeg LLC and successfully proved a debt of $12.2 million in a contested hearing Re Doonbeg Investment Holding Company Ltd [2022] IEHC 88
Advised a minority shareholder group in respect of the examinership of Mallinckrodt Plc. whereby $5.3 billion of long-term debt arising from opioid litigation was restructured. Re Mallinckrodt plc [2022] IEHC 157
Appeared in numerous shareholder / minority oppression disputes under section 212 of the Companies Act 2014, including representing the parties at mediation.
Acted for companies, members and creditors in company liquidations and examinerships. Represented both liquidators and directors in respect of restriction or disqualification applications.
Have moved applications to restore companies to the register, to reduce share capital and to extend the time for registration of company charges.
Acted for the Revenue Commissioners in bankruptcy proceedings including, Re Henry Dixon (A Bankrupt) [2021] IEHC 658 and [2022] IECA 220
Commercial
Appeared as sole counsel and obtained a worldwide freezing order / proprietary injunction over c.€500,000 worth of crypto currency, the second such order made in the State.
Appeared in several multi-million share purchase agreement warranty claims.
Represented restaurateurs, publicans and hoteliers in respect of business interruption claims arising from Covid-19. Including advices as to the scope of policy cover, interpretation and construction of contractual provisions and limitation and exclusion clauses.
Appeared for the plaintiff in a breach of software licence terms claim on behalf of the licensor of pharmaceutical stock management software against a pharmaceutical wholesaler
Act for banks, distressed debt funds and borrowers in summary debt recovery proceedings and receiver claims. Many of these matters arise from corporate lending over multiple facilities and subsequent loan portfolio sales.
Represent investors and brokers in claims for financial mis-selling.
Intellectual Property
Instructed as sole counsel for Blaabjerg Leg ApS a Danish manufacturer of children’s play apparatus ‘the Jumping Pillow®’ and obtained damages of €221,000 for breach of European Union Trade Mark.
Appeared for the manufacturer of a veterinary product in a breach of confidence claim.
Represented Abercrombie & Fitch in a breach of trade mark claim against an importer of counterfeit products.
Acted for artist in a breach of copyright claim in respect of the brand and advertising materials for a perfume brand.
